GENERAL CONDITIONS

The conditions set forth in this document govern and will apply to all sales carried out by RIERA RABASSA on their web page which is accessed via the URL http://www.anytimeisteatime.com

By placing an order the User is deemed to have read and accepted the present conditions of sale. We recommend printing a copy of this document for information purposes or for future reference.

These General Conditions will remain in force and maintain their validity as long as they are accessible via the Website. Without prejudice RIERA RABASSA reserves the right to modify the General and Particular Conditions as well as any of the legal texts that appear on the Website without prior notice. In any case, access to the Website by the User following its modification, entry and/or substitution implies their acceptance.

WEBSITE ACCESS AND REGISTRATION

The User may access and browse the product catalogue and/or services which appear on the Website http://www.anytimeisteatime.com free of charge without having to register.    

However, if the User wishes to purchase a product and/or service from the Website, they must register as a User by following the instructions below.

USER REGISTRATION REQUIREMENTS

To register as a User on this Website, the User must be over 18 years old. The User must provide all the data which is marked obligatory on the form made available by RIERA RABASSA on the Website. The registered User accepts that their User account is personal and non-transferable. Both physical and legal persons may register as a User of the Website. All registered Users will be given a password to access their account which in all cases is personal and non-transferable. The User may modify or recover said password at any time by following the procedure which is available on the Website. This password will never be made available to RIERA RABASSA. It will, however, remain in a coded format on the systems of RIERA RABASSA.

In accordance with the above, the User is obliged to notify RIERA RABASSA immediately of any misuse of their log in ID and/or passwords such as theft, loss or unauthorised access so that they can be immediately cancelled. Until such time, the Provider will under no circumstances be held liable for any misuse of the log in ID or passwords by unauthorised third parties.

UNSUSCRIBING AS A REGISTERED USER

By registering as a Customer of the Website, the resulting legal relationship will have an indefinite duration. Either of the parties may unilaterally decide to terminate or suspend the present contractual relationship at any time and without justifiable reason, without prejudice to the obligations arising from the placement of orders before terminating said relationship. The Customer may unilaterally exercise their right to termination by deleting their account.

Once the User has unsubscribed from their account, they may re-register as a new User. The Provider reserves the right to not accept said registration in the case of conflict or dispute between the two parties, which is in the process of being resolved or which has been finalised with the admission of fault or negligence lying with the User and/or with damages to the Provider, its collaborators and associates as well as its Users, customers and potential customers.

The range of products and services offered as well as their description and price will appear on screen.

RIERA RABASSA reserves the right to decide at any time which products and/or services will be available on http://www.anytimeisteatime.com.

RIERA RABASSA may add to the range of products and/or services. RIERA RABASSA may also withdraw or stop any of the products and/or services which are available on http://www.anytimeisteatime.com without prior notice.

Once the User has entered http://www.anytimeisteatime.com, they must follow the purchasing process instructions to access and procure products and/or services. The User must read and accept the general and particular conditions of purchase listed on http://www.anytimeisteatime.com.

INFORMATION AND AVAILABILITY OF PRODUCTS

All the information related to the range of products and/or services offered by RIERA RABASSA as part of their Online Shop will be published on the Website. This information will include the following:

-    Name
-    Description
-    Ingredients
-    Use
-    Weight
-    Price (includes taxes)

RIERA RABASSA may add products and/or services to those which already appear on the Website. It is understood that, unless otherwise stated, such new products will be governed by the provisions of the General Conditions in force at that time.
    
PRODUCTS

RIERA RABASSA  aims to guarantee the availability of all of the products and/or services which appear on http://www.anytimeisteatime.com. However, in the event that a product is unavailable or out of stock, the customer will be informed in the following way:

If the product and/or service is unavailable, the User will be contacted by telephone or by email. RIERA RABASSA will supply the User with a similar product and/or service at the same price. In this case, the User may accept or reject this offer by exercising their right of withdrawal and termination of the contract.

In the event that none of the products or some of the products of the order are unavailable and the User decides to reject the substitute products, a refund will be made in the same way as the initial purchase.    

SERVICES

For the provision of services, RIERA RABASSA will give the User access in the following way:

STEPS IN THE E-PROCUREMENT PROCESS.

Once the User has selected the products and/or services offered by RIERA RABASSA, the User must follow the procurement process as detailed below:

1 –Validate Shopping Cart: once the User has selected the products they wish to purchase, they must validate their shopping cart. This will show the selected products, the number of units, the price of each unit, any applicable discounts and the shipping costs.
2 –Provide billing and address details: After validating the shopping cart, the User must provide their billing and address details and give their express acceptance to the present Purchasing Conditions by clicking on the checkbox. In the event that the checkbox is left empty, the Website will not allow the User to proceed with the purchase.
3 -Select Payment Method: after providing the billing and if applicable, address details, the User must select the payment method. RIERA RABASSA currently validates the following payment method: credit card.
4 -Payment of the total amount: the User will pay the total amount via the software platform STRIPE which is integrated into the Website.
5 -Confirmation of Purchase: When the Customer has completed the payment process they will receive an email from RIERA RABASSA which will confirm their order. The Customer will receive another email when their order has been processed and the product is ready to be shipped.

FINANCIAL CONDITIONS AND PAYMENT METHODS.

FINANCIAL CONDITIONS

All products and/or services offered on the Website carry the final price of the product as well as any applicable discounts to the purchase.

The prices shown on the Website exclusively apply to the products offered via said channel and for the duration that they appear on the Website.

The price of each product will always be shown in Euros with either 10% or 21% VAT in accordance with the selected item(s) as well as any other applicable taxes which are in force and lawfully applicable at that time.

RIERA RABASSA expressly reserves the right to modify the prices at any time without prior notice. However, in all cases, the prices indicated on the Website when the order is made will  be applied.

PAYMENT METHODS.

To proceed to payment, the Customer must complete all of the instructions described above in Step 3 in the e-procurement process.

All payment methods made available by RIERA RABASSA are subject to checks and authorisations by the issuing entity of the payment method (card issuer and/or payment accounts issuer). However, if said entity does not authorise the payment, the purchasing process will stop, the order will be automatically cancelled and the purchase and sale of the requested product or products will not be completed.

The Customer will be charged for the price of the products, the shipping costs (if applicable) as well as any taxes to be levied when the order is placed. The shipping costs are calculated for all the national territory.

RIERA RABASSA uses an online sales payment platform provided by STRIPE to carry out electronic payments. Any data provided to RIERA RABASSA for these purposes is duly encrypted to guarantee their maximum security and confidentiality. Said data is stored in a secure server which is certified according to the Secure Sockets Layer protocol (SSL).

CONDITIONS FOR SHIPPING PRODUCTS

The products purchased via the Website belonging to RIERA RABASSA will be sent to the postal address indicated on the order form. RIERA RABASSA cannot send products to the following places: a post office box or public areas such as public roads, squares, stations, airports etc.

HOME DELIVERY

If requested, the delivery of the order to the User’s home address will take place within ten to fifteen working days following receipt of the order confirmation email. The product will be delivered to the postal address included on the order form except in cases of force majeure. The delivery note and invoice will be sent with the product(s).

PRODUCT

The order will be delivered to the address entered by the User at the time of purchase.

The delivery areas included under PENINSULA delivery include: Spain (Peninsula), Gibraltar and Portugal (Peninsula).

The delivery areas included under INTERNATIONAL delivery include:

-    ZONE 1: Germany, Austria, Belgium, Denmark, France, Holland, Italy, Luxembourg, Poland, United Kingdom, the Czech Republic.
-    ZONE 2: Bulgaria, Slovenia, Estonia, Finland, Greece, Hungary, Ireland, Latvia, Lithuania, Slovakia, Romania and Sweden.

THE RIGHT OF WITHDRAWAL (CANCELLATION OF AN ORDER)

The User has the right to cancel the order they made on the Website. If the User is not satisfied, they may return the product within a maximum of 10 calendar days following the date of delivery or, in the case of the provision of services, from the date when the online order for the contract was placed.

If the User wishes to exercise their right to withdrawal, they must notify Riera Rabassa via email rgpd@anytimeisteatime.com or in writing to Riera Rabassa, Volta Garrofers, 49, Pol. Ind Els Garrofers, 08340 Vilassar de Mar, Barcelona. Any written correspondence should indicate the User’s decision to withdraw from the contract.

The refund for the purchase will be reimbursed using the same payment method as was used for the initial purchase.

The Customer must send the product/s they wish to return without undue delay and in any case no later than 10 calendar days following the date they communicate their decision to withdraw. The Customer will incur the return shipping costs. RIERA RABASSA will not accept returns with unpaid shipping.

The refund for the corresponding amount of the purchase will be made within 10 calendar days following the date the decision to withdraw has been effectively and unequivocally communicated and the products have been returned. If this is not the case, RIERA RABASSA may retain the refund until said products have been returned or until the Customer can prove that they have been returned.

The following exclusions apply to the right of withdrawal:

a.    The supply of goods which are sealed and which cannot be returned for health and hygiene reasons or which have been unsealed after receipt.
b.    Any other goods or services protected by Article 103 of RDL 1/2007, of 16th November.

The Customer is liable for any diminished value of the goods resulting from their handling other than what is necessary to establish their nature, characteristics or functioning. In any case, to be able to exercise the right to withdrawal, the products must be returned in their original packaging and the invoice. In the event that the products are returned without their original packaging or they are damaged, the refund for the Customer will be adjusted correspondingly. Before returning the product, the Customer must ensure that the product is packaged and sealed properly to avoid any damage during transport.
 
GUARANTEE

When the product or products which have been purchased do not match the product description, are defective and therefore not fit for purpose, or do not perform as advertised, the Customer has the right to claim redress for their purchase within 14 calendar days following purchase and in the conditions and with the means of proof regulated by the amended General Law for the Protection of Consumers and Users, without prejudice to the faculties of the Point of Sale to check the veracity of the defects, their origin and when they first appeared. In the case of online sales, the Customer must send a photo of the product by email.

PROCESSING OF PERSONAL DATA

As controller and administrator of the Website, RIERA RABASSA will store all of the information provided during the procurement process. RIERA RABASSA will also be responsible for processing the data from the order on behalf of the Point of Sale. For this purpose, RIERA RABASSA will be the Data Controller of the  personal data of the Customers who have made the purchase.

The collected data will be made available to the transport and logistics company in charge of delivering the products which have been purchased on the web page http://www.anytimeisteatime.com. The data will also be made available to any other operator involved in the purchase or delivery process for the purpose of fulfilling the contract or contracts with the Customer and the resulting contractual relationship. In any case, the Customer must give their express consent before their data is communicated to any third party.

Similarly and unless otherwise indicated by the Customer, the User expressly consents to the processing of their personal data by RIERA RABASSA so that they may receive information of interest, updates and offers from RIERA RABASSA regarding their products and services via any means such as post, email, SMS etc. To unsubscribe from the mailing list for these communications, the User should send an email to rgpd@anytimeisteatime.com or consult the RIERA RABASSA Privacy Policy for further information.

The User may also contact RIERA RABASSA to exercise their rights to access, rectification, erasure and opposition at RIERA RABASSA (tax identification number A08963423) Carrer Volta de Garrofers, 49. Any written communication must include a copy of the User’s official identification document. The processing of personal data by RIERA RABASSA, the Points of Sale, as well as any other information which is requested to access and use the Website will be governed by the provisions stipulated by the Privacy Policy of the Website http://www.anytimeisteatime.com.

GENERAL INFORMATION

In accordance with existing legislation, the conditions set forth in this document have been published with adequate notice. RIERA RABASSA makes the current General Conditions available to the User so that they can be stored and reproduced in compliance with RIERA RABASSA’s legal obligation to provide information in advance.

RIERA RABASSA reserves the right to modify the presentation and configuration of the Website, its functionalities and/or content at any time and without prior notice. The User acknowledges and expressly accepts that RIERA RABASSA may interrupt, disable and/or terminate access and/or use of the Website at any time without being held responsible.

If any of the clauses stipulated in these General Conditions were to be declared totally or partially null or inapplicable by any competent Court, Tribunal or administrative body, it is only the full or partial part of those clauses which will be affected. In such cases, the affected clause or clauses will be replaced by similar clause(s) to those which have been removed.

GOVERNING LAW AND JURISDICTION

The parties expressly agree that all the terms and conditions of the present contract will be governed and interpreted in accordance with current Spanish legislation.

For any issues or discrepancies arising from the interpretation, compliance and execution of this contract, the parties expressly submit to the jurisdiction and competence of the Courts and Tribunals nearest to the User’s domicile or those nearest to the place of performance of the contractual obligation.

To lodge any complaints regarding the use of our services, the User can contact the Website controller via email or in person at the address which is detailed in the section “Website controller”. At all times we are committed to resolving any dispute amicably.
